In 1807 John and Mary left and moved to Ten. with their 2 younger children. the older children stayed until later and then moved to Tenn., Arkansas, Mississippi and Mo. The ones that went to Tenn. were in Buchanan (Paris Landing) and there was a town called Swor Town (after the Swor's) by Owens Hill
He died of pneumonia and then Mary (his wife) took to her bed and died 2 days after John.

'William C. Swor was a magistrate in Henry Co, TN in the early thirties, also Colonel of a militia company before the Civil War. He was a county surveyor of Henry County for ten or fifteen years. At the beginning of the war between the states he was elected Major of the 5th Tennessee Regiment; he commanded the regiment in the two-day battle of Shiloh, when he was promoted to Lt. Colonel. He also commanded in the battle of Perryville, KY on Oct. 8, 1862 when he had a horse killed under him, and was injured by another falling on him. In that same battle I lost my left hand; I was a young Sergent in the same command. Father afterwards served in the recruiting service, as he was disabled from further active military duty.'

Companies E (Capt. P. G. Swor) and M (Capt. John T. Winfrey) were the first outfits raised for the Confederacy, in April and May 1861. Along with other companies, these men were organized into the 5th Regiment, TN Infantry, at Paris, TN, and were sworn into formal service, 9 August. It was ordered to Columbus, KY, then at year's end to New Madrid, MO.; after several forays, to Corinth, Miss., before it saw service at Shiloh in april 1862. The regiment was reorganized after this battle; sent to East Tenn.; at the battle of Perryville, Ky.,
8 Oct. 1862. After acting in Tenn and Georgia, hard and worn veterans surrendered in NC at wars close. (TENNESSEANS IN THE CIVIL WAR, Civil War Centennial Commission, 1964, Pt. 1, pp 185-86). Note; Company E became Company C, 1862."

Mustered in as an "unassigned recruit" Feb. 1, 1864 at Metropolis, Massac Co, Ill. He is assigned to Co.D, 56th Infantry on Feb 2, 1864 and mustered out Aug 12, 1865 at Little Rock, AR. Description lists him as 18 years old, 5 ft, 6 in. tall, light hair, blue eyes, and light complexion. Occupation farmer. Term of enlistment is given as 3yrs. He enlisted with 1st cousin, 36 year old James R. Finley.
(2) 1880 census gives age 32, occupation "silver smith".

"Since the completion of the railroad a little village known as South Camden has sprung up around the depot, about on half mile south of town. It's business men at present are I. C. Yarbrough, N. E. Finley, J. F. Presson and A. J. Hudson (?) general merchandise; Lindsey McElyea, groceries; P. W. McDade, produce; A. J. Hudson, saw and grist mill."
(4) I have a copy of the Last Will and Testament of Newton R. Finley. It reads as follows;
"I N. E. Finley being of sound mind but feeble in health, and knowing that all men must die, and not knowing how soon I may pass away, and having a desire to direct the manner in which my effects may be disposed of after my decease do make and publish this my last will and testament, hereby revoking and making void any and all other wills by me made at any time.
1st
I direct that my body be burried in a respectable manner and my burial expenses be paid as soon thereafter as can be done of whatever effects I may leave.
2nd
It is my will that my beloved wife L. C. Finley have all of my property real and personal for the uses and benefit of her self and my children Effie, Carlos, Lovie, Arie and Clarie Finley equally.
3rd
That she continue to sell goods or to follow any other legitimate business that she may like or think best but this clause is not intended to compel her to follow any particular business and she may cease to do any kind of public business when in her opinion she believes the same does not justify her in following said business.

I have a small tract of land on the Tennessee River in the 11th Civil District of Benton County Tennessee known as the Oakhill (?) land that I desire my wife to sell but for a sum not less than three hundred and fifty $350.00 dollars, also one half 1/2 interest in the place in the 5th Civil District of Benton County bounded on the north by the NC and St. Louis Railroad, south by Steele and Sounders (?) , east by W. A. Steele Sr., west by Maddis (?), it being the same place which my father lived and I direct that she sell the place where we now live in connection with the store but for a sum not less than eight hundred $800.00 and if she does or should sell said property or either of said lands and property I autherize her to make a deed or deeds to the purchaser or purchasers in as full and ample a manner as if I had done the same in my lifetime, but I reserve the right to convey any of the above named lands during my lifetime if I see fit to do so and for any consideration and in case my wife L. C. Finley shall sell said lands the proceeds shall be controlled by her for her benefit and the benefit of my children above named.
5th
I autherize my wife L. C. Finley to collect all of my debts that may be due me at my death and ? for same and to make any settlement with any parties that may be owing me at my death or that I may owe, and the same shall be as legal and binding upon her and them as if I had done the same in my lifetime. And I further direct that my wife L. C. Finley transact any and all other business of my estate and without being required to give bond or qualify in any court of record(?) but the ? probate in the proper court of this will shall be the evidence upon which she will act.
6th
But the foregoing will is made upon condition that my wife L. C. Finley will remain single and conduct herself properly and prudently, but at her death , marriage or misconduct in her manners or behavior the above will becomes void in all of its items and bearings, and in case the aforegoing(?) will becomes null and void as above stated I hereby appoint my friend executor to this my last will , effects to be equally distributed between my children above named.

I Aire A. Finley of Camden, Benton Co, Tn being of sound mind but frail in health hereby make, declare and publish, this as my last Will and Testament:
1st
I direct that my body be burried in a respectable manner and that all my burrial expenses be paid by my Executor herein after named, and of any funds that I may have on hand at the time of my death, or that may first come into his hands as such Executer.
2nd
I direct that my Executor pay all my just and bonified debts.
3rd

4th

It is my will and wish that my brother, Carlos R. Finley, have all money and personal effects which I may have and my Executor is hereby directed to pay the same to him after first paying my funeral expenses and bonified debts as herein mentioned; except the sum of Twenty Five Dollars which I direct my same Executor to retain for the purpose of erecting a monument to my Mother's grave.

It is my wish and will that should my sister Clara Finley be married at the time of my death, then and in that event she and my brother Carlos R. are to share equally herein each having a one half, or should my sister Lovinia Ayers wife of R. W. Ayers, be not living with her husband as man and wife and dependent on my brother Carlos R. at the time of my death, then and in that event it is my wish and will that she the said Lovinia have a one third (1/3) interest in and to the property herein mentioned, but should my sister Clara be not married and my sister Lovinia be living with her husband and not dependent upon my brother Carlos then and in that event my said brother Carlos R. is to be the sole benificiary of all the property, both personal and real here in defined(?), my

I direct my Executor to collect what money I may have in the banks also a ?
yet due me from the Estate of my grand father A. J. Hudson, when paid to the Clerk and Master of the Chancery Court of Benton County Tenn., and dispose of same as here in directed.

(3) Note: I always wondered where Carlos Finley got his first name. I just came across information on the internet that there is or was a town, 3 miles northeast of Brookhaven, MS , called Carlos. Since my Carlos Finley lived in and is buried in Brookhaven, I wouldn't be surprised to find that he was named after the town of Carlos - probably born there.

" Brookhaven friends of the Finley family learned Monday morning of the unexpeced death of C. R. Finley, long time manager of Handleman's Store in Brookhaven, and a longtime resident of Brookhaven. Mr. Finley died early Monday morning in Atlanta.
The body was to be brought by train to Brookhaven early Tuesday morning. Brookhaven Funeral Home will be in charge of services.
Mr. Finley had resided in Atlanta the past two years. He was preceded in death by his wife several years ago when the couple resided in Brookhaven. He is survived by three daughters."

On this lot were a livery - saloon, barber shop; and E. E. McElyea and Son had a blacksmith and woodworking shop as well. T.W. Asunders built a two-story boock building with C. R. "MRS. C. R. FINLEY DIES AT HOSPITAL
Mrs. C. R. Finley, prominent Brookhaven matron, died at Kings Daughters Hospital at 6 p.m. January 23 following a long illness. She was 71. Funeral services were held Saturday, January 24, from the Brookhaven Funeral Home Chapel with the Rev. John Moore, pastor of the First Methodist Church, officiating. Interment was in Rosehill Cemetery.
Mrs. Finley, the former Pearl Davidson, was born and reared in Camden, Tennessee. She was a direct descendent of John Quincy Adams, one of the earliest presidents of the United States. She was the daughter of pioneer residents of West Tennessee, Olive Delane Adams and James Davidson. Educated in the public schools in Tenn., Mrs. Finley was a graduate of the Methodist College for Women in Jackson, Tennessee. She was a member of the Eastern Star and in her earlier years, prior to illness, was an active worker in religious circles, and participated in the social life of the community.
She had been a resident of Brookhaven for the past 28 years, moving here with her husband and three daughters, when Mr. Finley was transferred to Brookhaven as manager of Handleman's Department Store, a position he held for over 20 years. Prior to moving to Brookhaven, the family resided in Shreveport. Mrs. Finley is survived by three daughters, Miss Elaine Finley, Mrs. G. D. Whalen, and Miss Hilda Finley, all of Brookhaven; a niece, Mrs. W. C. Potts of Fort Orange, Fla and two nephews, L. M. Dorman of Houston Texas and Jack Presson of San Angelo, Texas.
Active pallbearers were T. E. Applewhite, Raymond Cohen, Lundie Johnson, Tullius Brady, Charles E. Brennan and Paul Turnbough. Honorary pallbearers were John B. Perkins, Sr., George Gulley, Jr., David Lovell, Earl Smith, Ashley Pybass, and James Alford, Jr."

(2) I visited Silome Springs, MO with my father, R. F. Ayres, looking for Lovie's grave. One elderly man who still lived near by told us where the grave yard was and we searched for it. It was unkept, overgrown with tall grass and thick weeds. There was no sign of any marker for Lovie Ayres. I don't remember if there were any other grave stones or not. We were there back in 1968 or so.

Born in the Carolinas. Thomas ran away from home when he was fifteen and worked for a while herding cattle on the Chisholm Trail. He was one of the last of the real old time cowboys. He met Margaret , his wife, in Mobeetie, Texas where they were married. They then moved to New Mexico where he ranched for some years until he lost his ranch in the Depression. He and Margaret "Maggie" moved to Joliet, Illinois where he went to work for Public Service Company, Commonwealth Edison and worked on his own small farm until moving to Eastern Colorado in the 1940's. They farmed at Vona, Colorado and then sold out and moved to Evergreen, Colorado where they lived until they both passed away.
