Mary Polly Rogers father was Captain "Billy" William Rogers b. 1740's; d. 8/28/1782 in NC after being wounded in a Revolutionary War skirmish. His wife was Elleada McNeeley. I have no info on William Rogers or Elleada's ancestors.

3. William Rogers2 Capps (Cason1) was born 14 Feb 1796 in Orange Co, NC, and died 6 Jan 1851 in Weakley Co, TN. He md Lucy Fly 12 Oct 1815 in Williamson Co, TN, daughter of Elisha Fly and Elizabeth Reed. She was born 23 Feb 1803 in Flytown, Weakley Co, TN, and died 14 Jan 1849 in Weakley Co, TN.

William Rogers Capps b. Orange County, NC 2/14/1796; d. 1/6/1851 Weakley County, TN. Came to Tennessee around 1813 after serving in War of 1812 in NC. Married Lucy Fly 10/12/1815 in then Williamson Co., TN (now Maury Co., TN). They had 12 children including John Rogers Capps (mentioned above) who is the ancestor of most of the Capps in West Tenn. currently. Another son was Henry Washington Capps. This is not the Henry Capps that married Anna Fly and is buried in Weakley County. Henry Washington Capps m. Nancy Grooms and went to Missouri. Another son was Elisha Fly Capps who went to Missouri and is the ancestor of most of the Missouri and Texas Capps.
William's father was Cason Capps b. abt. 1760's prob. in NC; d. 1833 in Orange County, NC. According to his will, he lists 4 sons and 3 daughters. The Henry Capps buried in Weakley Co. who was married to Anna Fly was not one of his children unless he was left out of the will on purpose. Cason also served in the War of 1812. Cason appears in the 1790 Hyde Co., NC census and the 1784 -1787 state property census of NC. I have found some records of his buying property at estate sales earlier than this.....I am not sure where I put them now... I moved recently! Anyway, I have never been able to locate Cason's
father. The estate sale records also list two other Capps that he might be related to, but I have yet to find anything else on them either. Cason was in Orange County by 1810 as he appears on that census. Cason was married to Mary Polly Rogers . This is where the Rogers name comes from in the Capps family. Three of Cason's sons had the middle name of Rogers.
William Capps had been on an errand to Christmasville or perhaps Pillowville on Jan 6, 1851 to buy cloth for a slave baby's dress when on his return, his horse was frightened, throwing him and killing him.
The last will of William Capps is on record in Dresden, TN. County seat of Weakley County. He willed, first, his soul to God who gave it, and his body to the earth from which it was taken to placed wherever his children thought best. An acreage of land was given each son, a horse, saddle and bridle to each daughter.
A number of the sons immigrated to Missouri, some later returned to Tennessee.

For many years called the Snellgrove place. In the 1920's 30's and 40's many holes were dug on this farm by people looking for gold. Legend was that the Fly's and Capp's buried gold there.
William Rogers Capps was born on Valentine's Day, February 14, 1796 in Orange County, North Carolina. He was the son of Cason Capps and Mary "Polly" Rogers. He was named after his grandfather William Rogers, Mary "Polly" Rogers' father, who died in the American Revolutionary War. William Rogers Capps was the first of _______ generations of Capps to carry the "Rogers" name. In fact, the tradition has carried 200 years all the way to 1996 with the birth of David Roger Capps. Another interesting note about the year of William's birth is that his future father-in-law, Elisha Fly, left North Carolina for Tennessee that same year just as Tennessee first became a state.
William and his father Cason served with the North Carolina Militia during the War of 1812. William was a private in the Third Regiment, Sixth Brigade, of Orange County, North Carolina. Their active service included a march to Hillsborough, North Carolina in November 1814. A certification of William's War of 1812 service is included on page ____. Soon after returning home from military service, William decided to set out for adventures in the new west of Tennessee, which had gained its statehood the same year William was born in 1796. Several members of the Capps, Rogers, and neighbor Prior families were at that time traveling westward. William was about 17 at the time of his departure from North Carolina. He borrowed $50 from his father Cason and headed west.
William's first stop was in Middle Tennessee in what was then Williamson County. He settled near the family of Elisha Fly, who had come to Tennessee in 1796 from Northampton County, North Carolina. William met and married Elisha's daughter Lucy Fly soon after his arrival. Lucy was only 12½ when they were married in Williamson County, Tennessee on October 12, 1815.
About 1820, the signing of The Cumberland Pact between the State of Tennessee and the Chickasaw Indian tribe opened up large tracts of land in West Tennessee for settling. Once again William and his wife Lucy felt the urge to travel west. Also making the trip to the new lands in West Tennessee were Elisha Fly and several other families including the Cochranes and the Sedwicks. According to the Carroll County Occupant Entry Book, William settled on 239¾ acres of land in Range 1, Section 4, between 1820 and 1825. On March 5, 1826, William bought 21 additional acres in the same area from his father-in-law Elisha Fly for $63. This piece of land was part of a 640 acre tract that Elisha Fly had purchased from Joseph B. Porter who was a representative of the State of Tennessee. Joseph Porter was probably selling land the State had obtained from the Chickasaws in The Cumberland Pact. The land on which William Capps and Lucy Fly settled was just north of the North Fork of the Obion River in the area known as "Flytown". The area is now known as "Staffords Store".
Carroll County was established by the Tennessee State Legislature in 1821 and Gibson and Weakley Counties were established soon after in 1823. All three of these counties and several others were carved out of the old Chickasaw Indian Lands. The earliest West Tennessee pioneers had come to the area in the late 1810's. At that time, the are was nothing but wilderness. One early settler told stories of killing more than 70 bear within the first year of his arrival in 1819. According to stories from Fly family members who traveled on to Missouri years later, one member of the Fly family was killed by a panther in West Tennessee. Even the famous Davy Crockett came to the area to hunt and explore the Tennessee wilderness. He was a neighbor of some of the Capps families in the area and stories still exist about his hunting and fishing with the Capps boys. In fact, William Rogers Capps' grandson James Monroe Capps, son of James Nicholas Capps, married Davy Crockett's granddaughter Margaret Catherine Whitehurst.
William's brother James Rogers Capps came to West Tennessee with his wife Polly Tier about 1826. William and James had been very close as children and now they were living as neighbors in Tennessee. Soon after James' arrival, Polly contracted a fever and died. James was left to raise his two small children alone until he met and married Sarah Justice in Carroll County in 1838.
During the 1820's and 1830's, William and Lucy prospered and continued to add land to what was by then a large plantation. William purchased 65 acres from R.E.C. Dougherty in September 1829 and 15 more acres from John W. Cochrane in September 1832. An additional 141 acres was added in September 1833 from Jeremiah Fly, who was Elisha Fly's brother. Also in 1833, William purchased 190 acres from B. Gillespie which brought his total land holdings to more than 755 acres. This land also included 84 acres acquired from William's brother-in-law John Richard Fly, who was Lucy Fly's brother. William and Lucy became quite wealthy for their time and area. Slave purchases were even made to harvest pumpkins, apples, and other crops, and tend to the large herds of horses and other livestock. William had come very far from a teenager traveling west with $50 of borrowed money to his name. One of William's responsibilities as a landowner in the area was upkeep of the local roads. In December 1829, he was appointed overseer of the main road from Christmasville to the northwest corner of Carroll County.
In late 1833, Willam received word from Orange County, North Carolina that his father Cason Capps had died. Cason and William had apparently not kept in contact since William left. In Cason's will, the $50 that William had borrowed 20 years earlier was taken from his inheritance plus interest (see page ___). William did not wish to make the long trip back to North Carolina and designated his brother Robert Rogers Capps to handle the sale of his portion of Cason's estate. William's portion of the North Carolina estate was sold to Robert in 1836. William sold the 253 acres of Orange County, North Carolina property to Robert for only $125.
After the death of Cason Capps, William Capps' sister Mary "Polly" Capps and her husband Lemeul Stout, who was a full blooded Cherokee Indian, left their home in Randolph County, North Carolina to be near William Capps and James Rogers Capps. They settled near the Obion River near the land belonging to Elisha Fly. Elisha's daughter Anna Fly and her husband Henry Capps were also neighbors, along with Davy Crockett. Henry died in 1835 leaving his wife Anna a widow with eight children and a ninth on the way. William Capps was an executor of Henry Capps' estate.
From 1839 to 1843, William served as overseer for another road crew in the area. He replaced Elisha Fly's son Jeremiah Nicholas Fly and some of his crew members included John Cantrell, Niece Cochran, William Capps' son Henry Capps, Willam's brother James Rogers Capps, JosiahMoore whose son Edwin L. Moore later married _________ Stafford, Elisha Fly's son John Richard Fly, and several others.
Fortunes turned bad for William Capps and Lucy Fly's family in the late 1840's. Within a four year span beginning in 1849, ten members of William's family would die. Two infant grandchildren of William died in early 1849: William Washington Capps, the firstborn son of Henry Washington Capps and Nancy Grooms; and the infant child of Matthew Earls and Mary "Polly Penny" Capps.
The most devastating loss of all to William Capps occurred in 1849. In January 1849, Lucy Fly was pregnant with her 12th child. As the story is told by members of the Capps family who later moved to Missouri, Lucy was a kind lady and she often assisted the slaves in the chores. On January 14, 1849, Lucy was helping the Capps slaves Harriet and Rachel weave cloth. She was suddenly gripped by terrible labor pains and Lucy and her child died in childbirth. Lucy's death at the age of 45 left eleven children ranging in age from 5 to 33 without a mother. The loss of Lucy was devastating to William and his health soon began to fail. Lucy Fly Capps was buried with her infant child on the William Capps land in Weakley County. The cemetery is now known as Capps Cemetery I or the William Capps Cemetery (see Appendix ___).
William recorded his own will on December 24, 1849, ten months after Lucy's death. He had never recovered from losing Lucy and by the time the will was written, William described himself as "being very sick but of sound mind and memory." He knew he was dying and would be leaving his children Pleasant, 16, Penelope, 14, William, 11, Sarah, 9, and Cicero, 6, as orphans.
About one year after writing his will, William left on an errand to Christmasville to buy cloth. According to family stories, William always carried the key to his cash box pinned to his suspenders. On his way home from Christmasville, his horse through him against a tree and William died there on January 6, 1851. Many believe that William was attacked and he horse was frightened on purpose. When William was found, the key and the cash box were missing. The mystery of William Rogers Capps death was never solved and was ruled an accident. William was buried next to Lucy on the William Capps land in Weakley County. The cemetery is now known as Capps Cemetery I or the William Capps Cemetery (see Appendix ___).
William Rogers Capps willed his "body to the dust from whence it came" and his spirit "to God who gave it." He instructed that his funeral expenses be paid with his own money and that all his possessions be sold including crops and grain to pay debts. He gave each of the children horses and furniture, and the land was divided. William's will was witnessed by his oldest son Henry Washington Capps and by Bright Grooms, who was the father-in-law of Henry. William's son Elisha Fly Capps was named executor of the will since he was reportedly the only one of the children who could read and write. The will is on file in Dresden, Weakley County, Tennessee. A complete transcription of the will is included in this book on page _____.
The William Rogers Capps family had always been a close family but with the death of both of their parents they began to disagree amongst themselves. Five of the children were under the age of 15 and were too young to make decisions. Elisha Fly Capps had been named executor of the family estate by William in his will and was caught up in many of the family arguements over how to deal with the property. By February 1851, Elisha had fulfilled his responsibilities of selling the estate's slaves at auction including Harriett, Rachel, Willis, Jackson, and Levi. Harriett was purchased by William's brother-in-law John W. Cochran for $501.50, William's son Francis Rudolphus Capps purchased Willis for $849 and later took him to Missouri when he moved there. Henry Washington Capps purchased the slave boy Jackson for $405 and Levi was bought by a man named Jeptha Cooper for $282. According to stories from Elisha Fly Capps' family, it took two full days to sell all of William's wealth.
Several of the younger children were placed in the care of guardians soon after William and Lucy's death. According to Weakley County court records, John W. Cochran became guardian of his nephew Pleasant B.R. Capps. J.H. McKenzie, a respected citizen of the area and friend of the Capps family, became Special Guardian of William Alexander Capps, Sarah Ann Capps, and Cicero Lafate Capps. One of J.H. McKenzie's relatives, James Monroe McKenzie, donated a large portion of land in Carroll County for new railroad lines. When the Memphis and Ohio and the Nashville and Northwestern Lines crossed in Carroll County on this land, a town sprang up and took the name McKenzie. The town was organized in 1865 and incorporated in 1869.
In August of 1853, John Rogers Capps and Penelope Ellender Prior Capps filed suit against the other heirs of William and Lucy. They did not want the land and possessions divided as Elisha Fly Capps was directed as executor of the will. Soon after all the arguing and accusations, Elisha Fly Capps packed a few belongings and his family and moved to Missouri. He would never return to Tennessee. Many years later Elisha's grandchildren discovered he had not even bothered to sell his portions of the estate. The original land deeds were still in the family's possession in the 1960's, but are now worthless. Elisha Fly Capps' grandson Alphus Capps from Missouri mentions the deeds in a letter written in the 1960's to John Rogers Capps' grandson James Harbert Capps in Tennessee. The letter is included in this on page ____.
Tragedy struck the family of William Rogers Capps and Lucy Fly many times in the 1850's. Lucy and the infant child died in 1849 and William died in early 1851. That same summer, the first of the children died, Mary "Polly Penny" Capps Earls, along with her infant son James Monroe Earls. Mary's husband Matthew Earls died two months later also in 1851. It is likely that a fever of some kind took their lives. William's mother Mary "Polly" Rogers Capps also died in 1851. She had lived to her 80's and died while living with her son and William's brother Robert R. Capps in Alamance County, North Carolina. In 1853, William's son James Nicholas Capps died in Grainger County, Tennessee. About the same time, William's brother James Rogers Capps died in Grainger County and William's sister Mary "Polly" Capps Stout died in Weakley County.
Many years passed before the children became close, some only by letters. Henry Washington Capps, Cicero Lafate Adron Capps, Francis Rudolphus Capps, and Elisha Fly Capps all went on to Missouri and became another generation of pioneers. Pleasant eventually went on to Oklahoma before attempting a return home to Tennessee in his old age. John Rogers Capps went to Mississippi for a time before returning home to Tennessee. Cicero Lafate also eventually made it back and Pleasant died in Arkansas trying to return. At least four of the sons fought in the Civil War though not all on the same side.
Nearly all of the West Tennessee Capps families and many of the Missouri and Texas Capps families can trace their roots back to William and Lucy. William had come to Tennessee as a teenager with nothing and married Lucy, a 12 year old girl. By the time of their death, they had ___ children and owned over ____ acres of West Tennessee land. The Capps family can be proud to claim William and Lucy as the beginning of a great legacy. Their gravesite can still be found in Weakley County (see photo and map).

In the name of God amen. I, William Capps, planter of Carroll County, Tennessee, being very sick but of sound mind and memory, do make and ordain this my last will.
First, I give all my body to the dust from whence it came to be buried at the discretion of my dearly beloved friends and my spirit to God who gave it; and as touching my worldly goods, where with it has pleased God to bless me with.
First,I direct that my funeral expenses and all my debts be paid as soon after my death as possible and out of any monies that I may die possessed of or that may first come into the hands of my administrator or my executor Elisha Capps; ---
Secondly, I give to Francis Rudolphus Capps one horse to be worth $40.00; ---
Third, I give to my son John R. Capps the file colt, which has been called his by the family; ---
Fourth, I wish and will to my son Pleasant B. Robertson Capps one horse, bridle and saddle to be worth $55.00, when he shall have reached the age of 18 years old; ---

This indenture made and entered into this the 9th of September 1833 between Jeremiah Fly of Carroll County and the State of Tennessee of the one part and William Capps of the State and County aforesaid of the other part witnesseth, that for and in consideration of the sum of seven hundred dollars in hand paid by the said Capps to Jeremiah Fly the receipt whereof is hereby acknowledged and hath bargained, sold, alienated, and conveyed and confirmed unto the William Capps a certain tract or parcel of land lying in Carroll County, Tennessee on the North side of the South Obion River being a part of a 640 acre tract granted to R.E.C. Dougherty bounded as follows, beginning on a stake and Dogwood pointer at E. This indenture made this 20th of October A.D. 1836 between William Capps of the County of Carroll and State of Tennessee of the one part and Robert Capps of the County of Orange and State of North Carolina of the other part witnesseth that the said William Capps for the sum of one hundred and twenty five dollars to him in hand paid at or before the signing of these presents the receipt whereof he doth acknowledge hath given, granted, bargained, and sold and by these presents do give, grant, bargain, and sell unto the said Robert Capps all his right title and undivided interest or distribution share in a certain tract of land situated in Orange County, State of North Carolina on the banks of the Great Alamance River adjoining the land of John Rogers, William Holt, John Osland, and Jeremiah Holt whereof Cason Capps, deceased, lived and died, seized and possessed of a good title for the said lands containing by estimation 253 acres be the same more or less. To have and to hold the said right title and undivided interest with its appurtenances to the said Robert Capps, his heirs and assignees forever, and to his and their only proper use and by proof and the said William Capps oath by these presents covenant and agree that he will forever warrant and defend his right title and undivided interest in said land to the said Robert Capps, his heirs and assignees and against the claim of all persons whatsoever. He came to West Tennessee with his wife Polly Teer circa 1835. William and James had been very close as children and now they were living as neighbors in Tennessee. Soon after James' arrival, Polly contracted a fever and died. James was left to raise his two small children alone until he met and married Sarah Justice in Carroll County in 1838.

Your James Rogers Capps has my Record Number #10338, and I recognize his marriage to one whose surname I had spelled "Tier" in the German manner. (It is the German word for "animal".)(It is pronounced "teer"). Was it "TIER" at that time, possibly Americanized to TEER down generation? I have changed my spelling in my data base, but you can tell me whether THAT was a mistake, if, indeed, it was "Tier" in 1832.
I looked closely in the recorded tombstone records for the cemeteries of William Rogers Capps and his cousin Henry Capps, both places of which I have visited in West Tennessee. I do NOT find your persons in either of those TWO places.
Do you have a good source for the death date of Polly as 1839? James R. Capps married Sara (McClure) Justice, widow of James Justice (with a son by Justice) 21 December 1839 in Carroll Co., TN. I do NOT know where James R. Capps is buried or either of the wives. I DO know that TWO sons of Sarah (McClure) Justice Capps (by Capps) are buried in a McClure Cemetery in the area. Also a son of ONE of them. There were two daughters of Capps by Polly Teer, one of whom married a Shelton. That's about ALL I can add to your information.

James and Polly went to west TN sometime in the era of 1835 and Polly died on the way there or in TN. James married Sarah McClure Justice, the widow of James Justice. She bringing two children by James Justice to the marriage. Then James Rogers Capps and Sarah had six of their own.

James Rogers Capps (1809/1850)
Child of Cason and Polly Rogers Capps
From the marriage records of Orange Co, NC, we find that James R. (Rogers) Capps (1809/1850) married Mary "Polly" Teer (Polly Tier on the marriage records) on December 24, 1832 in Orange County, NC. The bondsman was J.C. Turrentine. James R. Capps' parents were Cason Capps and Mary "Polly" Rogers Capps, the daughter of William and Elleada McNeely Rogers. Polly Teer's parents were Luke and Jenny Ruth Clendenin Teer, the daughter of William and Mary Ray Clendenin.
From the early Orange County estate records we find that Polly Teer and husband James Capps were still in Orange County in 1833. James and his brother Robert were named the executors of the estate of their father, Cason Capps, in that year. We also find James R. sold his real property to his brother Robert Capps.
There had been a terrible drought in Orange County in the era of 1820-1830. The lands had been farmed for a long period of time and was "wearing out" as a result of not replenishing the nutrients in the soil, along with other poor farming practices. Since James Rogers Capps' brother, William Rogers Capps, had migrated to Williamson County, TN in about 1815 and then on to Carroll County, which was actually Chickasaw Indian lands, it seems natural that James, Polly and their new daughter would move there. James R. is found in Gibson County in 1836 where he purchased items at the Henry Capps' estate sale.
In the census data and marriage records of Carroll County we find that James R. Capps remarried on December 1, 1838, to a "Sarah Justice" one year younger than he. (Note that the census data is inconclusive about Sarah's age. She is shown as 40 in 1850, 46 in 1860, and in 1870 she is shown as being 47.) The census data shows James R. as being born about 1809. From Sarah's father, William McClure's, will, probated in Carroll Co. TN in May 1857, she is revealed as the widow of James Justice. (His full name was James Gray Justice.) This will is in Will Book A, Carroll County, TN (September, 1822-1864), Pages 287-291. The passages of interest in this will are: "...I do give to James Justice Decd and my daughter Sarah Justice now is Sarah Capps one horse and saddle worth $75.00 and cow and calf $20.00. Done received." Surely this ESTABLISHES that Sarah Justice was Sarah McClure Justice at the time of her marriage to James R. Capps. Note the above will also references the following: "...The Judgment
that I had to pay for James Capps that was sold to Dell I wish it to come out of her estate that is to come out of my Estate the Judgement is about $75.00 interest."
James R. and Sarah were living in Carroll County before moving to Gibson County. In the Chancery Court Records, of Carroll County, we find the following: On October 1, 1841, James R. bought two tracts of land from George T. Ridley for $200. This property was estimated to be 57 acres and was lying in the 4th district, on Clear Creek, in Carroll County. This is the first time that James R. is shown in the deed records in Carroll County. Ridley acknowledged the deed in May, 1844 and it was registered in July, 1844. (Deed Book F, Page 150) On December 7, 1842, James R. sold this same property to R.D. Shoffner for $200. It was acknowledged by witnesses in January, 1844 and registered March 1844. (Deed Book F, Page 76) At the same time, James R. agreed to purchase from
Shoffner 112 1/2 acres for $393.75. James R. gave Shoffner notes for payment and Shoffner was to make him a deed. In December, 1843 James R. filed suit against Shoffner in Chancery Court. He claimed Shoffner had: [1] knowingly sold him an "unhealthy place," [2] had sold his notes to Oliver Huffman, [3] had failed to make him a deed, and [4] had no clear deed to the property in the first place. Depositions were taken of both sides. In summary, James R. had been sick while living on the land. He claimed the land and/or water on the place contained something that caused a disease called "milksick" that killed animals and caused illness in people and that Shoffner knew of this. The property was in the vicinity of Crutchfield's mill in the 10th District. The court papers indicate that James R. was not living on the property at the time of the lawsuit, having already moved away, possibly to Gibson County. In August 1844, the Carroll County Chancery Court granted a decree in James R.'s favor. In October 1844 Shoffner won an appeal to be heard April, 1845 in the Supreme Court in Jackson, TN.
Shoffner was bound to James R. in the amount of $600 and cost if he defaulted. These Supreme Court records are probably in Madison County and could contain more depositions and a final judgement. These records have not been researched to date. Authors note: Later research reveals that the classic "milksick" of this period of time was, in fact, cause by cows eating "white snake root plants" and passing the toxin produced onto the milkdrinkers, thus mildly poisoning them.
James R. was living in the 17th district of Gibson County, somewhere in the vicinity of the community of Skullbone, probably to the southwest of there, when the October 21, 1850 census was taken. At the December term of court in 1850 a guardian was appointed for Nancy Ann Capps, "minor orphan of James R. Capps,
DECEASED." This can be found in Gibson County, "Wills & Bonds 1846-1852," Book D, Page 275. This particular paper is dated December 2, 1850. SURELY THIS INDICATES, WITH A HIGH DEGREE OF CERTAINTY, THAT JAMES R. CAPPS DIED BETWEEN OCTOBER 21, 1850 AND DECEMBER 2, 1850!

We do not know when nor where Mary (Polly) Teer died. The serious Capps researchers that we have spoken to think she died on the way to TN or shortly after arriving there, "from the fever."
Due to her marriage date of 1832 and a daughter being born in 1834 we now conclude that Polly Teer Capps was born about 1810, certainly in Orange County, NC and certainly the daughter of Luke TEER, not Tier.

From research on the James Justice family we find that Sarah already had two children by James Justice when she married James Rogers Capps. They were: Bennett Justice, born about 1834 and Elizabeth Jane Justice, born about 1836. This is ESTABLISHED from the guardian records and administrator's bonds, in the court records of Carroll County, TN. In the Carroll County Court Minutes, 1843-1850, Part II, Page 224, dated, July Term 1846, the following is recorded: "This Day Allen A. Justice (brother of James Justice) came into Court and renewed his guardian's bond as the law requires for Bennett M. and Jane Justice, minor ORPHANS of James J. Justice, deceased in the sum of five hundred dollars with Benjamin Woodard & Green Utley, as his securities, who all
came into Court and acknowledged the due execution of the same which the Court received and approved and ordered to be filed."
Apparently Sarah McClure Justice Capps moved back to Carroll County after James R.'s death. An Administrator's Bond for Sarah Capps, in the amount of $300, was filed in Carroll County, December Term of court, dated December 4, 1854. John McClure, her brother, and Lemuel Stout were her securities. Shortly after February, 1855, Sarah filed an inventory record of James R.'s estate. From reviewing the inventory papers and considering the administrator's bond was only $300 we can establish it was a rather small estate. There are reports of papers concerning James R.'s estate as late as 1858. We think this was when Nancy Ann turned 21 and part of her father's estate passed to her.
These researchers are unaware of Sarah McClure Justice Capps death date or place. She and son Edward are known to have been living in the 3rd District of Carroll County when the 1870 census was taken. No trace of Sarah and her children has been found after 1870. There is speculation that they left the area possibly following other family members to the west and north.

Note that Nancy Ann Capps was not shown in the James R. Capps household in the 1850 census. Nancy Ann is shown in the house of Joseph Hampton, next door to James R. and Sarah. This area, in this period of time, had a terrible epidemic of yellow fever. Possibly she was there to escape the disease, or because of it. (Note in the next paragraph that Joseph Hampton had been appointed one of her two securities, probably before the census was taken.)
On June 3, 1850 James R. was appointed guardian of Nancy Ann, his daughter, along with Joseph Hampton and James M. Young as securities. This can be found in Gibson County, TN "Bond & Wills 1846-1852, Book D, page 249. The most likely reason for this is that grandfather Luke's wife had died and Nancy Ann was sent the $200 provided her by her grandfather's will. But why would Nancy Ann's father, and others, need to be appointed her guardian and securities by the courts? (The bond was for $500, could it be that it took all three of them to be worth $500?) The explanation for the guardian is this: in that period, when a minor received an inheritance the courts appointed a guardian to assure the money was used or retained for the child's benefit and not squandered in some tavern. The guardian had to make reports to the courts about expenditures, interest income, and other financial matters concerning the minor.

Also buried there is, Herman N. Capps; born August 28, 1872 and died Feb 24, 1873, the son of E.L. and E. Capps and the grandson of James R. and Sarah. There also is William McClure; born April, 1775 and died May, 1857, the father of Sarah McClure Justice Capps. According to Cousin James this information was copied by Marvin Clark sometime ago. These writers have visited the site and have verified this information is correct.

My Dear Sir and Cousin,
Your letter came to me on March 30, and it wasa delight to me to hear from you. I have never had the privilege of seeing any of my Capps relation except my father's brothers and their families. My father and one brother of his, John A. Capps are the only ones left of my grandfather's family. Elisha Fly Capps is my grandfather. He died June
12, 1891. The year that I was born. My father is 82 years of age and has been in poor health recently. If I rightly understand my father was named for your father, that is the Cicero part of the name.
My wife and I were in Tennessee last August and stayed all night in Dresden. I was trying to locate some of my relatives but did not have the information that I needed to find any of you. After coming back home I talked to my father and Uncle John and learned that the old Capps place was located on the Obion River South of Dresden.
While I was in Dresden I went to the Court house and found the record of my great grandfather's will and also the record of the sale of his property after his death. It was all of great interest to me.
You spoke of the record of the Capps family being in Weakley Co. I have the names and the date of the birth of members of your grandfather's family but if there is a record of the family that goes back farther than that I certainly want to get a copy of it. I have your grandmother's old Bible and I prize it very highly. She is my great grandmother. If I am rightly informed her maiden name was Lucy Fly.
I have been wondering if you could tell me where your grandfather, who is my great grandfather, is buried. If I ever have the privilege of coming to that country again I would like to visit his grave and the old place where my grandfather was raised. It is possible, perhaps for me to find the old Capps farm but I may be unable to find the
grave which I mentioned unless there is a grave stone bearing the name.
Perhaps you would like to know something of the writer of this letter. I am about six feeet in height, weigh two hundred pounds and I am in my forties as you may see by a statement made earlier in this letter. I am married and have two children. A girl sixteen years old and a boy twqelve years of age. I was conerted and started out in the
christian life ninteen years ago. Began preaching about sixteen years ago, and apart of that time I have been in school. I have held many revivals and have baptised hundreds of people. I am now pastor of a church of about 350members.
I hope that I may be able to visit you some time but I do not know just when I could do so. It is but a fee hours drive from here to Dresden. I came home from there last summer in about five hours time.
I shall close hoping to hear from you again.

*Note: What is happening here is Fred Capps, son of Cicero Lafate Adron Capps, and Alphus Capps, son of Henry Grandville Cicero Capps, grandson of Elisha Fly Capps, are trying to recover land that was never sold by the Capps children. However, the land could not be recovered because of the time lapse involved. The people that lived on the land and paid the taxes all those years claimed ownership. Which is very legal. Whoever pays the taxes has the right to the roperty. That would have been the ancestors of Joe W. Stout, who is involved in the genCom project in collecting records and stories in Dist. 16 or 17. That is why the Wm. Capps cemetery is on Joe W. Stouts property. Joe told me he inherited the land which is very true. His family had paid the taxes on that
land for about 100 years. Therefore, Fred and Alphus Capps could not claim ownership to the land - that's called a day late and a dollar short.
